Procedures for extending foreigners’ temporary residency in Vietnam

Here are some steps to follow:

Step 1: Prepare documents in accordance with legal requirements.
Step 2: Submit your application
For Vietnamese companies and organizations, Vietnamese citizens and foreigners lawfully residing in Vietnam, submit at one of two working offices of the Immigration Department – Ministry of Public Security:
1. Hanoi: 44 – 46 Tran Phu, Ba Dinh District.
2. Ho Chi Minh City: 333 – 335 – 337 Nguyen Trai, District 1.
Working time: Monday to Saturday morning (except for public holidays, New Year’s days).
When your application undergoes review:
+ If it is valid, the office will receive it, print and hand out a receipt, and set a date to return the results.
+ If it is not valid, the applicant will be advised to complete it.
Step 3: Receive results:
The applicant who comes to receive the result must provide the receipt issued on the day of application submission, make a payment, and sign if the extension of temporary residency is approved.
Working time: Monday to Friday (except for public holidays, New Year’s days)
Application submission: Submit directly at the office of the Immigration Department of the Ministry of Public Security.
Dossier Requirements: 01 sets, as follow:
a. Application form for the grant, supplement, visa amendment, and temporary residence extension (Form NA5).
b. Foreigners’ passports or valid international travel documents.
Processing time: No more than 05 working days from the day dossiers are received.
Subjects of application: Agencies, organizations, and legitimately residing foreigners in Vietnam.
Competent authorities: Immigration Department and Ministry of Public Security.
Results of administrative processes: Stay extension
Fees (if any): USD 10.
Application form (if any): Declaration of application for the grant, supplementation, alteration of visa, and renewal of temporary residence (Form NA5 attached to Ministry of Public Security Circular No. 04/2015/TT-BCA, dated January 5, 2015).

Requirements and conditions (if any):
1. Agencies and organizations that apply to the Department of Management for issuing, supplementing, or modifying visas or extending temporary residence for foreigners or Vietnamese possessing foreign passports are required to provide their judicial records.

2. Foreigners and Vietnamese having foreign passports must have valid passports, visas (unless in circumstances where visa exemptions apply), and temporary residency permits issued by competent Vietnamese authorities to remain in Vietnam, and significantly does not fall under the categories of “Not permitted to enter Vietnam” or “Temporarily suspending exit.”

3. Vietnamese nationals having foreign passports who apply for grants, visa amendments, or extensions of temporary residence for foreigners must have a parent, spouse, or child relationship with the foreigner, and Vietnamese citizens holding foreign passports (present proof of relationship).

1. The Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam, No.47/2014-QH13, issued 16 June 2014.

2. Law No.51/2019/QH14 of the National Assembly of Vietnam, dated September 25, 2019, amending some articles of the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam.

3. Ministry of Public Security’s Circular No.04/2015/TT-BCA dated January 5, 2015, offers entry, exit, and residence forms for foreigners in Vietnam.

4. Ministry of Public Security’s Circular No.57/2020/TT-BCA dated June 10, 2020, amending some articles of Circular No. 04/2015/TT-BCA dated January 5, 2015, governing the form of paper documents about the entry, exit, transit, and residence of foreigners in Vietnam.

5. Ministry of Public Security’s Circular No.25/2021/TT-BTC dated April 7, 2021, prescribing the collection rates, collection regimes, payment, management, and use of fees in the field of exit and entrance, transit, and residence in Vietnam.

6. Ministry of Public Security’s Circular No.31/2015/TT-BCA, issued July 6, 2015, guides the issuance of visas, temporary residence cards, immigration permits, and permanent resident settlements for foreigners in Vietnam.
